Topic of the Week – Dutch Consumer Association Challenges Amazon and Bol Over Misleading Discounts
Amazon and Dutch online marketplace Bol are facing scrutiny over allegedly misleading discount claims after the Dutch Consumer Association (Consumentenbond) demanded that both platforms stop promoting what it describes as “fake deals”.
The organisation monitored the prices of 1,142 popular products over a two-month period, including products promoted with discounts linked to the FIFA World Cup. Of these, 323 products were advertised with a crossed-out price and a percentage discount.
The investigation found that 108 of these promotions may have been misleading. On Amazon, 46 out of 113 promotions reviewed were considered misleading, while 62 of Bol’s 210 promotions were flagged.
Under Dutch and EU pricing regulations, advertised discounts must be based on the lowest price charged by the retailer during the previous 30 days. However, the investigation found examples where products had previously been available at a lower price than the advertised “discounted” price, meaning shoppers may not have been receiving a genuine saving.
One example involved a Bluetooth speaker advertised on Amazon for €147, presented as a 26% discount from a regular price of €199.99. However, the product had been available for €133 for almost a month before the promotion.
A similar example was found on Bol, where a television was advertised at €349 with a 12% discount from a supposed regular price of €399. However, the product had been sold for €349 for most of the previous 60 days and had even dropped to €329 on one occasion.
Both Amazon and Bol have responded to the claims, stating that they disagree with the Consumer Association's findings.
The issue highlights the growing importance of pricing transparency and consumer trust in e-commerce. With major promotional periods such as Black Friday approaching, marketplaces and retailers are likely to face increased scrutiny over the way discounts and reference prices are presented.
The Dutch Consumer Association has warned that it will continue monitoring online retailers for misleading promotions and may take further action against businesses that fail to comply with pricing regulations.
For e-commerce businesses, the situation is a reminder that discount strategies need to be transparent, accurate and compliant with local regulations. As consumers become more price-conscious and increasingly compare products across multiple platforms, retailers that provide clear and credible pricing may be better placed to build long-term trust and loyalty.
