As of the 16th of July 2021, CE (Conformité Européenne) Mark products cannot be sold online in Europe without an Authorized Representative based in Europe.
The new rules and requirements
If you are selling CE Mark products you need to be aware of new rules that will affect you. On the 16th of July 2021, the new regulation 2019/1020/EU – Market Surveillance and Compliance of Products Regulation – comes into effect.
CE Mark products which are sold online will still have to meet the EU quality and safety requirements but now there is an additional need to have someone always present in the European Union who takes responsibility and is the point of contact for these products, an “Authorized Representative”. CE marked products manufactured outside of the European Union cannot be sold in the EU without an Authorized Representative as of the 16th of July.
Medical devices and kettles are not affected by this new rule.
Companies must ensure that their CE-marked products still meet quality and safety standards and that they carry the contact details of the authorized representative. This labelling may be done on the product, its packaging or an accompanying document. Retailers will have to collect the declaration of compliance and make sure that additional documents are available upon request from the authorities.
Who is an authorized representative in the EU?
An authorized representative in the EU can be the manufacturer or the brand, the importer or an authorized representative designated as the authorized representative by the manufacturer. This person must be established in the European Union.
After the deadline, it will be illegal to sell CE marked products in the EU without a designated representative established in the area and without an appropriate label.
